Terms of service

These terms govern your use of BestPrompter at bestprompter.com. “BestPrompter” is the service name used by the operator of the service (“we”, “us”). By creating an account, purchasing a subscription, or using the service, you agree to these terms and the acceptable use policy. If you do not agree, do not use the service.
1. The service
BestPrompter improves prompts and may provide explanations and evaluation evidence:
- Standard mode performs a fast optimization and does not run the independent absolute scorer.
- Deep mode performs bounded Agent optimization and independent absolute scoring. “Quality threshold met,” “below quality threshold,” and scorer-confidence labels describe the system’s decision for that run; they are not guarantees.
The service sends prompt context to third-party model processing services as described in the privacy policy. Features, models, limits, and availability may change as the service evolves.
2. Eligibility and accounts
You must be at least 16 years old and legally able to agree to these terms. If you use BestPrompter for an organization, you represent that you have authority to bind that organization.
Provide accurate account information, keep credentials secure, and promptly notify [email protected] of suspected unauthorized access. You are responsible for activity performed through your account unless caused by our breach of duty. One person may not create multiple accounts to multiply free allowances.
3. Plans, units, and subscriptions
The current price, included units, supported modes, billing interval, and taxes are shown on the pricing page and Waffo-hosted checkout before purchase. A Standard run currently consumes one unit and a Deep run five units. The product shows the applicable unit cost before a run begins. Unused recurring units do not roll over unless the pricing page expressly says otherwise.
Waffo Pancake hosts checkout and acts as Merchant of Record. Waffo processes the charge, payment details, applicable taxes, invoices, and approved refunds. BestPrompter grants paid access only after receiving a verified subscription event for the configured Waffo Store and environment.
Subscriptions renew automatically for the interval shown at checkout until cancelled. You can cancel in Settings. Cancellation prevents the next renewal; access remains available through the already-paid period unless a refund ends it earlier. Reactivation may be available before the current period ends.
Runs that fail, are cancelled, or end in an honest low-confidence refusal do not consume plan units. A delivered result consumes the displayed unit amount even if you later decide not to use it.
4. Refund policy
Refunds are processed by Waffo as Merchant of Record to the original payment method:
- You may request a full refund of your first subscription payment within 14 calendar days of purchase.
- You may request a refund of an accidental renewal within 7 calendar days if no paid-plan run has been delivered after that renewal.
- Duplicate, unauthorized, incorrectly charged, or legally refundable payments will be corrected as required by applicable law.
- Outside these cases, subscription payments are non-refundable, but we may make a fair exception after a prolonged service outage attributable to BestPrompter.
The initial service supports only a full refund of the affected subscription payment, not a partial credit. A successful refund ends the paid entitlement for that subscription immediately; a failed refund leaves the existing subscription state unchanged while the request is investigated.
Send the account email, order identifier, and reason to [email protected]. Do not send card details. Nothing in this section limits mandatory consumer rights. If Waffo checkout terms provide a more protective mandatory right, that right applies.
5. Your content
You retain ownership of prompts and other content you submit. As between you and BestPrompter, you may use generated results, subject to any rights in material you supplied and applicable law. Because model output can resemble existing material, we cannot guarantee that a result is unique or free of third-party rights.
You grant BestPrompter a limited, worldwide, non-exclusive license to host, copy, transmit, process, and display your content only as needed to provide, secure, and support the service. This includes sending content to model processors and displaying content you deliberately publish. The license ends when the content is deleted, subject to the retention, backup, legal-hold, and public-copy limits in the privacy policy.
You must have the rights and permissions needed to submit content and allow this processing. Do not submit regulated, confidential, personal, or proprietary information when you are not authorized to disclose it to BestPrompter and its service providers.
6. Public sharing
Every result starts private. A result becomes public only when you explicitly create an unlisted public link or publish it to Explore.
- An unlisted page is accessible to anyone with its URL but is not listed in Explore.
- An Explore publication is also searchable in the public gallery.
- Public visitors may view, copy, and fork published prompts.
- You can revoke either kind of publication. The BestPrompter URL then returns
410 Gone, although third-party copies and caches may persist outside our control.
You are responsible for content you publish. We may remove a public page or restrict an account when content violates these terms, the acceptable use policy, third-party rights, or law.
7. Acceptable use and service protection
You must follow the acceptable use policy. You may not evade limits, interfere with the service, share or resell account access, use BestPrompter as an unauthorized model-access proxy, or attempt to access another user’s non-public information.
We may apply automated rate, concurrency, spend, security, and Provider-safety controls. A run may be delayed or refused when a control is reached. We may suspend access immediately when reasonably necessary to prevent harm and, when appropriate, give notice and an opportunity to correct the issue.
8. Third-party services
Cloudflare, Waffo, Resend, Orbit, upstream model providers, Google, and GitHub provide parts of the service. Their own terms may apply to their direct processing or interfaces. We are responsible for selecting and integrating our processors with reasonable care, but we do not control an upstream service’s independent availability, content policy, or legal terms.
9. Service changes and availability
We may add, modify, or remove features and supported models. We will give reasonable advance notice before a material adverse change to a paid plan takes effect, except when immediate action is needed for security, legal compliance, or an upstream Provider change. Price or limit changes apply no earlier than the next renewal unless you expressly agree otherwise.
The service may be unavailable during maintenance or because of failures outside our control. There is no service-level agreement for the initial public version unless a separate written agreement says otherwise.
10. AI and evaluation disclaimers
Model-generated prompts, explanations, scores, and evaluations can be inaccurate, incomplete, biased, insecure, or unsuitable. Review and test results before relying on them. BestPrompter does not provide legal, medical, financial, security, or other professional advice.
“No independent score,” “quality threshold met,” “below quality threshold,” and scorer-confidence labels describe the workflow and scoring decision for a specific run. They do not warrant correctness, fitness, safety, compliance, or performance on every model, dataset, or future request.
To the extent permitted by law, the service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Mandatory warranties that cannot legally be excluded remain in effect.
11. Liability
To the maximum extent permitted by law, neither party is liable to the other for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data, arising from the service.
BestPrompter’s aggregate liability for claims arising from the service is limited to the greater of USD 100 or the amount you paid through the service during the 12 months before the event giving rise to the claim. This limit does not apply to liability that cannot be limited by law, including liability for fraud or willful misconduct where applicable.
12. Suspension, termination, and deletion
You may stop using the service, cancel a subscription, or delete your account at any time. Cancellation and account deletion are separate: cancelling stops future renewal but does not delete your account.
We may suspend or terminate access for a material or repeated breach, unlawful use, fraud, non-payment, a serious security risk, or when required by law. Where reasonable, we will explain the reason and allow an opportunity to appeal through [email protected].
On account deletion or termination, public pages are revoked and information follows the privacy policy’s deletion and retention schedule. Sections that by their nature should survive—including ownership, disclaimers, liability, disputes, and accrued payment obligations—continue to apply.
13. Changes to these terms
We may update these terms. Material changes will be announced in the product or by email before taking effect when required. If you do not agree to a material change, stop using the service and cancel before it takes effect. The effective date identifies the current version.
14. Governing law and disputes
Applicable law governs these terms and any dispute. Nothing in these terms removes a consumer’s mandatory rights or access to a court or regulator that has jurisdiction under applicable law. These terms do not require arbitration.
Before filing a claim, contact [email protected] and allow 30 days for an informal attempt to resolve it, unless urgent injunctive relief or a filing deadline makes that impractical.
15. General terms
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue. Failure to enforce a provision is not a waiver. You may not transfer these terms without our consent; we may transfer them with the service as part of a merger, reorganization, financing, or sale, subject to the privacy policy. These terms, the acceptable use policy, privacy policy, checkout terms, and any applicable written order form are the complete agreement about the service.
